Section 1. Service Description
We undertake to sell you the product on the terms as stated. No waiver, alteration or modification of the terms of this agreement shall be binding upon the Company unless made in writing and duly authorised by a Director of the Company. We reserve the right at any time and from time to time to modify the Services with or without notices. This does not affect your statutory rights as a consumer.
The prices are correct at the time of going to press. The Company reserves the right to revise these prices without prior notification. The Company will not, however, revise any contractual prices that it has committed to.
Section 2. Customer Obligations
You must provide the Company with true, accurate, current and complete information about yourself. Further, you undertake to advise the company about any changes to the information supplied, if any such changes occur within 14 days of receipt of the goods ; e.g. change of address and credit/debit card details.
Section 3. Customer Conduct
You undertake to treat the company’s property with respect and care and will do your best to ensure that no damage is caused to the lamp or to the packaging. The product remains company property until payment has been made in full.
The Customer undertakes to use the Equipment in accordance with the Manufacturers operating instructions and to notify the Company immediately of any apparent defects in the Equipment.
The Customer will take such steps as are necessary to ensure that any defects in the Equipment which might endanger the safety or risk of the health of any person are made known immediately to the Company and immediately prevent such use.
Section 4. Home Approval Scheme
The purchase price of the lamp must be paid in full before despatch.
Please note that you may arrange to return the product and packaging at any time within 14 days by telephoning 0800 036 1136.
The Company reserves the right not to accept a returned product after this period elapses. In addition to your Statutory Rights, The Company operates a Home Approval Policy. If you choose to use the product during the 14 days, but then decide against keeping it, only the Home Approval Charge of £69.99 becomes payable.
For all returns, please retain proof of posting from your shipper. Without this we cannot be responsible for any items that fail to reach us. Once the Company accepts the return, the Company issues a refund of the purchase price less £69.99.
If at the end of the 14 days you decide you wish to replace your lamp with another which has not been trialled, this may be done by paying an additional £50.00 to cover costs of administration, collection and redelivery.
Section 5. Product Warranty
A twelve month warranty is effective from the date of receipt of goods. Your statutory rights are not affected.
Section 6. Ownership of Product
Title to the Equipment remains with the Company until the Company receives full payment from the Customer (or a customer representative) for the sum specified on the customer order.
Section 7. Notice
All notices to the Company herein provided are recommended to be sent by the Customer in writing by 1st class post to the Secretary of the Company and the Customer must retain the relevant receipt otherwise notice shall not be considered as being duly given.
Section 8. Limitation of Liability
For business customers, under no circumstances will the Company be responsible for any loss of business or profits or for any other consequential loss or loss however arising including delay in or failure to deliver the Equipment.
Section 9. General Information
This agreement shall be governed by and shall be enforced in accordance with the laws of England and Wales and the Company and the Customer hereby submit to the jurisdiction of the Courts of England and Wales.
The Company will make every endeavour to supply the Equipment by the scheduled date.
No more than one trial per household at any one time.
